HB 78 Summary

• Amends Hawaii Revised Statutes Section 269-27.6 to allow public utilities to build high-voltage electric transmission lines underground without Public Utilities Commission (PUC) approval under specified conditions

• Exempts underground transmission projects from PUC approval if the entire additional cost of underground construction (versus above-ground) is paid by a third party as a contribution in aid of construction

• Requires the utility to file a detailed report with the PUC and consumer advocate prior to construction, documenting the transmission system and confirming that all additional underground costs will be paid by an entity other than the utility

• Grants the PUC 60 days to review the report; if no action is taken within that timeframe, the utility may proceed with the project

• Effective date: July 1, 2021
