HB 803 Summary

• Increases electric vehicle (EV) charging space requirements for public accommodations with 100+ parking spaces from one space to five spaces per 100 stalls by January 1, 2025, and ten spaces per 100 stalls by January 1, 2030.

• Requires all new EV charging systems installed after January 1, 2022 to be at least Level 2 charging stations that are network-capable.

• Authorizes each county to adopt ordinances enforcing EV parking requirements and maintaining charging stations in working order, with authority to establish penalties for non-compliance.

• Permits law enforcement officers and commissioned volunteer enforcement officers to access private property to enforce EV parking space violations.

• Allows property owners with multiple facilities to aggregate compliance across all properties, and permits them to charge reasonable fees for charging station use; exempts parking lots in federal flood hazard areas from requirements.
