Amends Hawaii Revised Statutes Section 46-6.5 to clarify county authority over public access rights-of-way dedicated by subdividers and developers.

Counties may require subdividers to establish and initially fund a stewardship fund controlled by the county for improvement and maintenance of the right-of-way, rather than the county assuming all costs.

Alternatively, counties may require the subdivider or its successor in interest to form a planned community association responsible for improving and maintaining the right-of-way.

Addresses the problem that existing public access requirements lack sufficient funding and clear responsibility assignment, making the dedications ineffective.

Effective January 1, 2022.
