HB 823 Summary

• Repeals the task force on beach and water safety (established by Act 190, Session Laws of Hawaii 1996) and the risk assessment working group (established under section 171-8.6, Hawaii Revised Statutes).

• Requires approval from both the chairperson of the board of land and natural resources and the respective county mayor for the design and placement of warning signs, devices, or systems on public beach parks and improved public lands.

• Removes consultation requirements with the now-defunct task force and working group from warning sign approval processes under sections 663-1.56 and 663-52, Hawaii Revised Statutes.

• Maintains the conclusive presumption of legal adequacy for properly posted warning signs for dangerous ocean conditions and natural hazards on public lands when approved through the revised process.

• Effective date is January 1, 2050.
