HB84 Summary

• Establishes a "stand your ground" law allowing persons using deadly force to have no duty to retreat if they are not engaged in criminal activity and have a right to be in the location.

• Authorizes use of deadly force when a person believes it is necessary to protect themselves against death, serious bodily injury, kidnapping, rape, or forcible sodomy.

• Removes language permitting deadly force use at a person's place of work, eliminating the exception that previously allowed actors to stand their ground in workplace locations.

• Modifies HRS §703-304 to update pronouns and clarify that duty to retreat does not apply to a person's dwelling unless the person was the initial aggressor.

• Takes effect upon approval with no retroactive application to proceedings that began before the law's effective date.
