Require past performance evaluation for all competitive sealed bids and proposals exceeding the small purchase threshold, as well as for sole source contracts.

Mandate that procurement officers consider past performance along with financial ability, resources, skills, capability, and business integrity when determining offeror responsibility.

Require written documentation of past performance reviews in sole source contract determinations and include evaluations in contract files.

Appropriates funds from general revenues for fiscal year 2021-2022 to the state procurement office for implementation of this Act across executive branch departments and agencies.

Takes effect July 1, 2021.
