HB 847 Summary

• Requires the Department of the Attorney General to study the establishment of a centralized Office of Administrative Adjudications to separate judicial functions from investigatory, prosecutorial, and policy-making functions in state executive branch agencies.

• The study must be conducted in conjunction with the Department of Commerce and Consumer Affairs, Department of Health, and other affected agencies.

• Study shall identify departments conducting hearings, review personnel and resource requirements, determine hearing jurisdiction types, and identify legal conflicts and barriers affecting administrative hearings.

• Department of Attorney General must submit a report to the legislature no later than 20 days before the 2022 regular session convening, including findings, feasibility assessment, cost analysis, and recommendations for legislation.

• The proposed Office would not replace hearings functions of political subdivisions, legislative agencies, judicial agencies, the Governor's office, or the Lieutenant Governor's office.
