Department of Health shall submit an application for immediate relief to the DEA Drug Enforcement Administration under 21 CFR section 1307.03, stating that Hawaii's cannabis authorization laws (HRS chapter 329 Part IX and chapter 329D) create a federal exemption and do not conflict with federal drug laws.

Application must include a proposed rule stating that marijuana's federal controlled substance listing does not apply to state-authorized cannabis use and that persons using marijuana in compliance with state law are exempt from federal registration requirements.

Department of Health shall also submit a petition for permanent relief under 21 CFR section 1308.43 with the same legal arguments and proposed rule language regarding state authorization exemptions.

Legislature finds that international drug treaties contain exemptions for authorized controlled substance use under domestic law, and that Hawaii citizens using authorized cannabis are hindered by lack of federal exemption in obtaining supply or traveling with their medicine.

Act takes effect upon approval.
