HB 96 Summary

• Amends Section 46-88, Hawaii Revised Statutes to increase the maximum area for agricultural shade cloth structures, cold frames, and greenhouses from 20,000 square feet to 60,000 square feet per structure while maintaining the 15-foot minimum horizontal separation requirement between multiple structures.

• Structures qualifying for the exemption must not be used as dwellings or lodging units and must comply with all applicable state and county zoning codes to be exempt from building permit and building code requirements.

• Maintains exemptions for other agricultural buildings including nonresidential manufactured buildings, recycled shipping containers (up to 1,000 square feet), aquacultural structures, livestock watering systems, fencing, farm production buildings, raised beds, and horticultural tables.

• Effective date of January 1, 2050.
