H.C.R. No. 108 Summary

• Urges Congress to call a constitutional convention under Article V limited to proposing amendments that impose fiscal restraints on the federal government, limit federal power and jurisdiction, and establish term limits for federal officials and members of Congress.

• Declares that Congress has only ministerial authority to call such a convention and set the time and place for initial meetings, with no power to determine convention rules, set delegate numbers, or name delegates.

• Establishes that states shall vote on a one-state, one-vote basis at the convention and that the convention is limited solely to the specified topics with an absolute prohibition on any amendments affecting the Bill of Rights.

• States this application shall remain in effect as a continuing application until legislatures of at least two-thirds of the states submit applications on the same subject and authorizes Hawaii to provide further instructions to its delegates or recall them for breach of duty.

• Directs transmission of certified copies of this resolution to the leadership of both chambers of Congress and to the presiding officers of the legislatures in all other 49 states.
