Request that the U.S. Food and Drug Administration provide individual Premarket Tobacco Product Application (PTPA) applicant information for Hawaii e-cigarette and electronic nicotine delivery system (ENDS) sellers to the Hawaii Department of the Attorney General for law enforcement purposes.

Urge the Department of the Attorney General to identify Hawaii sellers who do not have pending or approved PTPAs in compliance with FDA requirements and transmit that information to the FDA for enforcement.

Require the Department of the Attorney General to submit a comprehensive report on actions taken pursuant to this measure to the Legislature no later than 60 days before the 2022 Regular Session convenes.

Cite concerns that Hawaii youth vape at twice the national rate and Hawaii has the highest or second-highest rate of e-cigarette use among middle and high school students nationally.

Direct transmission of certified copies of the resolution to the FDA Commissioner, Centers for Disease Control and Prevention Director, Governor, Attorney General, and Director of Health.
