S.B. 10 - Affordable Housing Summary

• Requires each county to adopt reasonable standards allowing religious and educational institutions to design and build housing units on land they own in fee simple, regardless of current zoning restrictions.

• Housing constructed under this provision must be either exclusively for Hawaii residents who are owner or renter occupants owning no other real property, or affordable housing as defined in the bill.

• Defines "affordable housing" as dwelling units leased to individuals with gross annual income less than $72,300 or sold to individuals with income not exceeding 60% of the area median income.

• Defines "religious institution" as organizations not restricting membership based on race, color, or ancestry with no earnings accruing to private shareholders, and "educational institution" as private organizations with 501(c)(3) tax-exempt status.

• Any institution building affordable housing under this section must comply with chapter 515 and sections 302A-1601 to 302A-1612.
