SB 1176 Summary

• Conservation and resources enforcement officers with conferred police powers may stop and briefly detain any person reasonably believed to be engaged in hunting or fishing to inspect licenses, permits, and harvested game or aquatic life.

• Officers may inspect game, aquatic life, and containers reasonably used to carry them within reasonable distance from the hunting or fishing area, but cannot inspect clothing or containers unrelated to carrying game or aquatic resources.

• Mobile inspections during detentions are prohibited unless the officer has probable cause or the person fails to heed a demand to stop and submit to inspection.

• Penalties for refusing to comply with inspection requests include fines of up to $1,000 for first violation, $2,000 for second violation within five years, and $3,000 for third or subsequent violations within five years.

• The Act takes effect upon approval and does not affect rights, duties, or proceedings that occurred before the effective date.
