HI SB1246

Prohibits counties from enacting ordinances that prohibit persons from sitting or lying by the roadside, in accordance with article IX, section 10 of the Hawaii State Constitution.

Allows county officials to remove a person from a roadside only if conditions exist that would place the person at risk of immediate bodily injury.

Defines "by the roadside" to include any sidewalk as defined in section 291C-1.

Establishes statutory protection for the "law of the splintered paddle," a Native Hawaiian principle requiring care and protection for vulnerable populations including the elderly, women, and children.

Takes effect upon approval.
