Authorizes the Department of Land and Natural Resources to establish and operate aquatic in-lieu fee mitigation programs in addition to existing aquatic mitigation banks.

Allows in-lieu fee mitigation to be used for restoring, creating, enhancing, or preserving aquatic habitats or resources where compensatory mitigation is required.

Permits in-lieu fee mitigation for prospective damages to aquatic habitats where the requiring agency approves this approach, or for compensating past damages to aquatic habitats or resources.

Amends Chapter 187A, Part IV, Hawaii Revised Statutes to retitle the section "Aquatic mitigation banking and aquatic in-lieu fee mitigation" and updates related statutory language.

Takes effect upon approval.
