S.B. 387 Summary

• Establishes conditions for room confinement of children in juvenile detention and adult jail facilities, limiting use to temporary responses when behavior poses immediate danger to self/others or serious threat to facility safety, or when child is an imminent escape risk.

• Requires room confinement only be used for minimum time necessary after less restrictive options (de-escalation, behavioral management, mental health intervention) have been attempted and failed.

• Limits initial room confinement to maximum of 3 hours, with on-call judge able to extend up to 3 additional hours; confinement exceeding 3 hours requires family court hearing on next business day with legal representation for child.

• Mandates notification to senior judge, presiding judge, deputy chief court administrator, and social services manager within next business day of any room confinement, and prohibits use for punishment, discipline, coercion, retaliation, or staffing convenience.

• Requires adequate lighting, ventilation, suicide-resistant facilities, and child access to water, hygiene supplies, meals, family contact, legal assistance, and medical/mental health services equivalent to general population.
