SB 413 Summary

• Amends Hawaii Revised Statutes Section 853-4 to exclude violation of privacy offenses from eligibility for deferred acceptance of guilty plea or nolo contendere plea.

• Excludes violation of privacy in the first degree under section 711-1110.9 from deferred plea eligibility.

• Excludes violation of privacy in the second degree under section 711-1111(1)(d), (e), (f), (g), or (h) from deferred plea eligibility.

• Makes these violations ineligible for deferred plea status alongside other serious offenses including felonies, violent crimes, and certain sexual assault and drug crimes.

• Takes effect upon approval with no retroactive application to proceedings begun before the effective date.
