S.B. 474 Summary

• Requires sellers of residential real property in Hawaii to disclose whether the property lies within the sea level rise exposure area as designated by the Hawaii climate change mitigation and adaptation commission.

• Adds sea level rise exposure area to the list of material facts that must be disclosed in mandatory seller disclosures under Hawaii Revised Statutes chapter 508D, alongside existing disclosures for flood hazard areas, airport noise exposure areas, and tsunami inundation areas.

• Directs each county to provide maps identifying properties within the sea level rise exposure area by tax map key number and allows counties to charge reasonable copying fees for map copies.

• Updates references from "Flood Insurance Administration maps" to "flood maps promulgated by the National Flood Insurance Program of the Federal Emergency Management Agency."

• Takes effect on May 1, 2022.
