S.B. 540 Summary

• Allows the governor or mayor to designate violations of emergency rules as "emergency period infractions" with a default fine of $200 per occurrence, or other amounts as designated in the rule.

• Enables emergency period infractions to be adjudicated through the existing traffic infraction process under Chapter 291D rather than through criminal penalties.

• Permits electronic delivery via email of notices of infractions, hearing notices, and judgment notices for both traffic and emergency period infractions.

• Grants district courts concurrent jurisdiction with family courts to hear emergency period rule infractions committed by minors.

• Renames Chapter 291D from "Adjudication of Traffic Infractions" to "Adjudication of Infractions" to incorporate emergency period infractions into the existing streamlined adjudication system.
