S.B. 615 Summary

• Requires moped and motor scooter rental companies to equip all rental vehicles with safety flags extending at least 5 feet above the ground, triangular in shape with minimum 30 square inches, in fluorescent orange color.

• Mandates that persons renting mopeds or motor scooters from rental companies wear safety helmets provided by the company (unless providing their own), except those with valid motorcycle licenses.

• Exempts persons holding valid motorcycle licenses or equivalent licenses from other states from the helmet requirement when operating rented mopeds or motor scooters.

• Prohibits rental companies from leasing any moped or motor scooter with aftermarket motor modifications that do not comply with manufacturer specifications or that increase power capacity above two horsepower.

• Establishes penalties up to $500 for violations of the aftermarket motor modification prohibition and becomes effective July 1, 2021.
