S.B. 791 Summary

• Reduces the timeframe for vessel owners to reclaim impounded unauthorized vessels from 30 days to 10 working days, and abandoned vessels from 20 days to 10 working days.

• Authorizes the Department of Land and Natural Resources to charge impound storage fees equal to the rate for vessels moored without a valid permit while vessels remain in custody.

• Makes vessel abandonment in state waters or on public property a petty misdemeanor punishable by a fine of up to $1,000 and/or up to 30 days imprisonment, with each day of violation counted as a separate offense.

• Clarifies criteria for determining abandoned vessels, including vessels moored without valid permits for more than 72 hours or lacking valid registration/documentation, and simplifies public auction procedures by removing the $5,000 appraised value exemption threshold.

• Shortens the administrative hearing request period from 10 days to 5 working days after receipt of impound notice and specifies procedures for grounded vessels, allowing immediate department control if removal cannot be accomplished within 24 hours for vessels in imminent danger.
