SB808 Summary

• Renames the "school facilities agency" to the "school facilities authority" and establishes it as a body corporate and public instrumentality of the State placed within the Department of Education for administrative purposes only.

• Creates a five-member school facilities authority board appointed by the governor, with at least one member having active or previous construction industry experience for at least five years; board members serve without compensation but may be reimbursed for expenses.

• Grants the authority's executive director power to serve as chief executive officer and chief procurement officer, with a six-year term subject to senate confirmation; the director is exempt from civil service and collective bargaining laws.

• Expands the authority's powers to enter into public-private partnerships, borrow money and procure loan guarantees from federal government, issue bonds, appoint independent attorneys for specialized legal services, and recruit exempt and technical personnel through the Department of Human Resources Development.

• Transfers the total fund balance from the state educational facilities improvement fund to the school facilities special fund within 180 days of the effective date; Act effective July 1, 2021.
