S.B. 913 Summary

• Requires persons receiving state funds in counties with populations over 750,000 to donate unused but functioning electronic devices and televisions to nonprofit refurbishers annually beginning January 1, 2022.

• Establishes "covered refurbisher" organizations that must be 501(c)(3) exempt, registered with the state, maintain a physical location in Hawaii, and can repair and refurbish devices for distribution to eligible recipients at a maximum price of $50 per device (excluding enterprise hardware).

• Eligible recipients include nonprofit organizations, government entities, and Hawaii residents determined to be in need; recipients and refurbishers are prohibited from reselling or leasing received devices.

• Requires covered entities to remove all data from devices before donation and file annual reports to the Department of Accounting and General Services detailing device type, charitable contribution amount, and refurbisher name.

• Establishes penalties of up to $1,000 for first violations and up to $2,000 for subsequent violations; effective July 1, 2050.
