S.B. 928 Summary

• Expands the works of art special fund to support performing arts in addition to visual art, allowing the State Foundation on Culture and the Arts to commission, record, and display performances.

• Requires performing arts to be recorded on audio, video, or audiovisual files and archived as state property with the State holding exclusive copyright under the works made for hire doctrine.

• Adds definitions for "performing arts" (dance, music, theater, motion pictures, screenplays, and similar works) and "performance of art" to Hawaii Revised Statutes Section 9-1.

• Modifies the works of art special fund allowable uses to include costs for performance, recording, and upkeep of performing arts works alongside existing visual art acquisition and maintenance.

• Takes effect upon approval.
