S.B. 980 Summary

• Requires condominium boards of directors to convene and vote on requests from unit owners susceptible to secondhand smoke for reasonable accommodations to mitigate smoke from neighboring units.

• Reasonable accommodations may include temporary smoking prohibitions in neighboring units, directions to smoke in designated areas away from the property, or other reasonable measures.

• Board must schedule the meeting no later than a specified number of days after receiving a request, with notice issued to the requesting unit owner and affected neighboring unit owners.

• Allows unit owners to submit subsequent requests if initially denied, with the board required to convene annually on new requests for up to at least two meetings.

• Permits unit owners to pursue alternative dispute resolution under subpart D if their request is denied a second time.

• Effective date: July 1, 2021.
