Authorizes the Board of Land and Natural Resources to issue a 25-year, non-exclusive easement to the Association of Apartment Owners of Wailea Elua for a beach access stairway on state submerged lands at Wailea, Maui (Tax Map Key: (2) 2-1-008).

Resolves a shoreline encroachment consisting of a stairway (originally built in the 1970s with 22 square feet extending into state lands) that provides access from the Wailea Coastal Walk to Ulua Beach for public and resort guests.

Grantee must pay the state fair market value of the easement as determined by independent appraisal.

Easement is exempt from environmental assessment requirements per Hawaii Administrative Rules and Department of Land and Natural Resources exemption list reviewed by the Environmental Council on November 10, 2020.

Board of Land and Natural Resources approved the easement issuance at its January 22, 2021 meeting; legislative concurrent resolution approval is required by Hawaii Revised Statutes section 171-53.
