Authorizes the Board of Land and Natural Resources to issue a term, non-exclusive easement for state submerged lands at Tax Map Keys (2) 4-3-002:026, 027, and 028 in Napili 2 and 3, Lahaina, Maui.

The easement covers approximately 142 square feet of additional encroachment area for an existing walkway, stairs, shower station, concrete pier blocks, and landscaping on Napili Kai, Ltd.'s property.

The new easement is required because the original Grant of Non-Exclusive Easement No. S-5998 (issued October 25, 2010) did not cover state submerged lands, which require separate legislative authorization under Hawaii Revised Statutes section 171-53.

Napili Kai, Ltd. paid $4,200 in February 2019 for the fair market value appraisal of the additional encroachment area.

The new easement will be coterminous with the existing GL5998 easement and run with the land for the benefit of the abutting property for use, repair, and maintenance of existing improvements.
