S.C.R. NO. 179 Summary

• Requests formation of a working group to examine governance and maintenance of shared areas (private roads, recreational facilities, mailboxes, infrastructure) in non-planned community subdivisions created prior to statehood.

• Working group shall examine rights and responsibilities of homeowners and management entities, review regulatory frameworks in other jurisdictions, and gather information on maintenance costs and funding mechanisms.

• Working group composition includes one House member and one Senate member from affected districts, plus representatives from the Hawaii State Association of Parliamentarians, Hawaii Council of Community Associations, Community Associations Institute Hawaii Chapter, and a certified mediator.

• Working group must submit findings, recommendations, and proposed legislation to the Legislature no later than twenty days before the 2022 Regular Session convenes and shall dissolve on December 31, 2022.

• Members serve without compensation; addresses gap in statutory guidance that currently exists for condominium associations (HRS § 514B) and planned community associations (HRS § 412J).
