Request the Legislative Reference Bureau to conduct a study on best practices regarding "incidental and supplemental" contracting work in Hawaii's construction industry.

Study shall examine how other state jurisdictions define and handle "incidental and supplemental" contracting work and identify factors beyond cost that licensing boards use in determining this classification.

Require the Legislative Reference Bureau to obtain input from stakeholders including construction unions, construction companies, structural engineers, steel fabricators and erectors, and trades councils.

Require submission of a report with findings, recommendations, and any proposed legislation to the Legislature no later than twenty days before the 2022 Regular Session convenes.

Stems from the 2013 Hawaii Supreme Court case District Council 50 v. Lopez, which clarified that "incidental and supplemental" work must be subordinate to the primary licensed work and represent less than fifty percent of total project cost.
