Senate Resolution 13 - Summary

• Requests the Department of Land and Natural Resources convene a task force to resolve jurisdictional and operational issues at the Hanapepe Chinese, Filipino, and Portuguese Cemetery located on state-owned land (Tax Map Key (4) 1-8-008:018) on Kauai.

• Task force shall examine outstanding jurisdictional issues regarding cemetery use, steps needed to resume burials, and any other identified issues; burials were halted in July 2020 due to unclear management authority.

• Task force membership includes the Governor, Chairperson of the Board of Land and Natural Resources (to serve as chair), Director of Health, Comptroller, Director of Commerce and Consumer Affairs, Mayor of the County of Kauai, Kauai County Council committee chair, Director of Parks and Recreation of the County of Kauai, and other appropriate persons.

• Task force members are exempt from Hawaii Revised Statutes Chapter 84 (conflict of interest laws) solely due to task force participation; Department of Land and Natural Resources shall provide administrative support.

• Task force must submit findings and recommendations to the Legislature no later than twenty days before the 2022 Regular Session convenes; task force dissolves on June 30, 2022.
