H.B. 1052 Summary

• Expands the definition of "airport hazard" to include animals, reflective surfaces or materials that blind pilots, and specific facilities such as landfills, composting facilities, recycling facilities, fish farms, wastewater treatment facilities, wetland mitigation sites, and dredge spoil containment areas that may attract wildlife.

• Establishes a five-statute-mile airport hazard area extending from the airport property boundary as shown in the airport layout plan, with airport hazard area maps to be adopted by each county by May 31, 2022.

• Requires state and county agencies to consult with and receive comment from the Department of Transportation before issuing land use or building permits for applications within five statute miles of an airport operating area when a proposed use or action may cause an airport hazard.

• Mandates that county general plans, community plans, development plans, and other long-range planning documents acknowledge and map airport hazard zone areas for state airports and coordinate with the Department of Transportation to prevent airport hazards.

• Takes effect upon approval.
