HB 1310 Summary

• Requires public schools, private schools, and public charter schools to have at least one trained employee on duty during the entire school day to administer seizure rescue medication and assist with vagus nerve stimulator magnet use, effective January 1, 2022.

• Mandates training for school personnel through either an adopted training program or instruction by a physician, advanced practice registered nurse, or physician assistant on seizure recognition, symptoms, and first aid.

• Requires all principals, guidance counselors, and teachers to complete at least one hour of annual self-study review of seizure disorder materials developed by medical professionals.

• Requires schools to establish a seizure action plan for each student with a diagnosed seizure disorder in conjunction with parents/guardians, and distribute the plan to all employees supervising the student.

• Exempts schools without enrolled students who have a seizure disorder or seizure rescue medication prescribed, and provides liability protection for school employees administering seizure medication in compliance with the law.
