HB 1328 Summary

• Bans the sale of flavored tobacco products and e-liquids, mislabeling of e-liquid products containing nicotine, and remote sales of tobacco products (mail, delivery, online) effective July 1, 2021, with penalties ranging from $1,000 to $5,000 for retailers.

• Includes electronic smoking devices and e-liquid in the definition of "tobacco products" for tax purposes and imposes a 70% excise tax on gross receipts from retail sales of electronic smoking devices effective July 1, 2021.

• Increases license fees for tobacco wholesalers/dealers from $2.50 to $2,500 and retail tobacco permit fees from $20 to $100.

• Directs a percentage of cigarette and tobacco tax revenues to the Hawaii Tobacco Prevention and Control Trust Fund to establish a comprehensive youth tobacco cessation program.

• Repeals the electronic smoking device retailer registration system and delivery sales provisions for e-cigarettes; requires youth violators to complete tobacco education programs, use cessation programs, or perform community service as alternative to fines.
