Defines "pre-contact historic property" as any building, structure, object, district, area, or site that existed prior to 1779, including heiau, fishponds, agricultural complexes, and habitation sites.

Adds a new duty to the historic preservation program requiring development, publication, and distribution of public informational materials regarding statutory protections for burials, historic sites, and archaeological resources and the project review process.

Increases maximum civil penalties from $10,000 to $20,000 for general violations and establishes a new $30,000 maximum penalty for violations involving loss of or damage to pre-contact historic property.

Increases maximum penalty for offering prehistoric or historic human remains or associated burial goods for sale or trade from $10,000 to $25,000.

Makes landowners and developers jointly and severally liable for costs of mitigation and preservation measures ordered by the department for violations occurring on their projects.
