HB 1416 Summary

• Adds requirement that emergency powers must be consistent with Hawaii's state constitution, in addition to existing federal law requirements.

• Requires any suspension of laws during emergencies to be no broader and last no longer than necessary, with specific identification of suspended law sections and justification based on protecting public health, safety, and welfare.

• Establishes that a state of emergency automatically terminates after 60 days, by separate gubernatorial proclamation, or by concurrent resolution adopted by the legislature, whichever occurs first.

• Allows the governor to declare a new state of emergency for the same underlying disaster only upon governor's request and legislative adoption of a concurrent resolution, limiting extensions to 60 days at a time.
