Prohibits retailers from selling, offering for sale, or possessing flavored tobacco products beginning January 1, 2023, including products with menthol, candy, fruit, chocolate, and other characterizing flavors.

Prohibits mislabeling or marketing e-liquid products that contain nicotine as nicotine-free.

Establishes fines of up to $500 for first violations and $500-$2,000 for subsequent violations by retailers and their agents or employees.

Authorizes counties to adopt more stringent restrictions on flavored tobacco products than state law, with the more stringent restrictions prevailing in case of conflict.

Defines "flavored tobacco product" to include any tobacco product containing a constituent that imparts a characterizing flavor, but excludes products that received FDA marketing authorization.
