• State moneys for health and human services procurements shall be the funding source of last resort, with providers required to pursue all alternative funding sources before using state funds.

• Purchasing agencies must give preference to applicants who are qualified Medicaid providers when soliciting competitive purchase of services contracts.

• When two competing applicants are otherwise equivalent, the purchasing agency shall select the applicant who is a qualified Medicaid provider.

• Non-Medicaid provider applicants awarded contracts have up to one year from the notice of award date to apply and become qualified as Medicaid providers.

• The Department of Health must provide providers with a memorandum of understanding explaining how to capture federal Medicaid moneys when applicable.
