HB 1712 Summary

• Prohibits waste disposal facilities on agricultural lands classified with overall productivity rating class A or B, and on important agricultural lands.

• Permits solar energy facilities on class B and C lands only with special use permits, requiring lease rates at least 50% below fair market rent for compatible agricultural activities and financial security for decommissioning.

• Restricts solar energy facilities to no more than 10% of parcel acreage or 20 acres (whichever is lesser) without a special use permit, and prohibits them entirely on class A lands.

• Adds a new policy requirement that state and county agricultural policies prohibit creation of waste disposal sites on important agricultural lands.

• Takes effect July 30, 2075.
