HB 1736 Summary

• Allows licensed teachers who have retired to be employed as teachers during a state of emergency declared under Hawaii Revised Statutes chapter 127A without the standard 12-month waiting period.

• Permits recently retired teachers to return to work if no pre-retirement agreement existed between the state or county and the retirant for return to work after retirement.

• Requires the department of education or charter school to contribute the required percentage of the rehired retirant's compensation to the pension accumulation fund to amortize the system's unfunded actuarial accrued liability.

• Applies only to teachers who held a valid license issued by the Hawaii teacher standards board at the time of separation from service.

• Takes effect July 1, 2051 and repeals June 30, 2023, with section 88-9(d) Hawaii Revised Statutes reverting to its prior form upon repeal.
