Amends Section 353-16.3 of Hawaii Revised Statutes to require legislative approval by concurrent resolution for any agreement negotiating out-of-state correctional facilities.

Beginning July 1, 2022, requires out-of-state facility contracts to include a tiered per-diem compensation structure: full contracted rate until inmate serves minimum sentence and becomes parole-eligible, then 50 percent of contracted rate from parole eligibility until transfer back to the department.

Mandates that out-of-state facilities maintain the same standards of care, health, and safety policies as in-state facilities, including policies and procedures for appeals related to restricted confinement practices such as administrative segregation and disciplinary segregation.

Effective date is July 1, 2022.
