HB 1938 Summary

• Requires all state, county, and private bus operators to transition to 100% zero emission buses by January 1, 2035.

• Defines "zero emission bus" as a motor vehicle carrying more than 15 passengers that produces zero exhaust emissions, including battery-electric and hydrogen fuel cell-electric buses.

• Prohibits the Public Utilities Commission from issuing new motor carrier certificates or permits for transporting more than 15 passengers after December 31, 2034, unless all vehicles are zero emission buses.

• Mandates that county mass transit systems cannot operate non-zero emission buses starting January 1, 2035, and voids existing certificates or permits for non-compliant buses on that date.

• Requires the state to only enter into new school bus contracts for zero emission buses, with the requirement effective immediately for contracts extending past January 1, 2035, and mandatory for all new contracts starting January 1, 2035.
