HB 1991 Summary

• Prohibits the sale of bicycles reported as stolen and listed on a publicly available online database in counties with populations of 500,000 or more, with violations punishable as a misdemeanor with fines of $500, the advertised sale price, or actual sale price, whichever is greater.

• Requires county police departments or designated agencies in counties with 500,000+ population to establish and maintain a publicly available online stolen bicycle database that allows verification of bicycle serial numbers and emblem numbers.

• Provides an affirmative defense if a seller checked the stolen bicycle database before the sale and the bicycle was not listed at that time.

• Updates recordkeeping requirements for pawnbrokers and secondhand dealers to include photographs of sellers, photographs or detailed descriptions of items (including serial and emblem numbers), and a signed copy of pawn transaction agreements.

• Requires dealers in counties with 500,000+ population to submit completed transaction forms electronically through a county-provided webpage, online service, or application at no cost; exempts dealers that have continuously operated since January 1, 2002 from photograph submission and electronic filing requirements.
