H.B. 2051 - Hawaii Consumer Privacy Act

• Establishes the Hawaii Consumer Privacy Act creating comprehensive consumer privacy protections and business obligations regarding personal information collection, use, sale, and sharing.

• Grants consumers rights to delete personal information, correct inaccurate information, know what information is collected and how it is used, and opt out of sales or sharing of personal data.

• Requires businesses meeting specified thresholds ($25 million+ annual revenue, 100,000+ consumers' data sales annually, or 50%+ revenue from data sales) to provide notice of data practices, implement security measures, and honor consumer requests within 45 days.

• Prohibits discrimination against consumers exercising privacy rights and restricts use of "dark patterns" to manipulate consent; establishes special protections for minors under 16 years old.

• Authorizes the Department of Commerce and Consumer Affairs to adopt rules and enforce violations with administrative fines up to $2,500 per violation or $7,500 per intentional violation involving minors; effective January 1, 2023.
