H.B. 2144 Summary

• Authorizes the Department of Human Services to conduct comprehensive background checks on current and prospective employees, volunteers, and contractors working in positions requiring close proximity to minors, young adults, or vulnerable adults receiving child welfare services, social services, or foster care support.

• Requires criminal history record checks, consent to obtain criminal history information, and checks of adult abuse and child abuse/neglect registries for covered positions.

• Allows the Department to periodically obtain updated criminal history records and may terminate or deny employment/services if individuals pose a risk to the health, safety, or well-being of vulnerable populations.

• Makes conforming amendments to Hawaii Revised Statutes sections 346-2.5, 378-2.5, and 846-2.7 to expand background check authority and update terminology related to foster care and child welfare services.

• Takes effect upon approval.
