H.B. 2150 - Summary

• Prohibits the sale, offer for sale, or possession with intent to sell of any flavored tobacco products in Hawaii, effective January 1, 2023, including products with menthol, candy, fruit, coffee, and other characterizing flavors.

• Bans mislabeling or marketing of e-liquid products as nicotine-free if they contain nicotine.

• Establishes penalties of up to $500 for first violations and $500-$2,000 for subsequent violations for retailers and their agents who violate the ban.

• Allows any flavored tobacco products found in a retailer's possession to be seized as contraband and destroyed immediately without following other forfeiture procedures.

• Permits counties to adopt more stringent restrictions on flavored tobacco products than the state law, with the most restrictive rules prevailing in case of conflict.
