HB 2189 Summary

• Allows manufacturers holding a general excise tax license and either a state Class 1, 14, or 18 beer/distilled spirits license, or an out-of-state beer/distilled spirits manufacturing license, to obtain a direct beer and distilled spirits shipper permit from their county liquor commission.

• Permits permit holders to directly ship beer and distilled spirits to persons age 21 and older in Hawaii for personal consumption only, beginning July 1, 2022.

• Requires shipments to be in containers labeled "CONTAINS ALCOHOL: SIGNATURE OF PERSON AGE 21 YEARS OR OLDER REQUIRED FOR DELIVERY" and mandates carrier collection of adult signatures before delivery.

• Obligates permit holders to annually report total shipment amounts to county liquor commissions, pay all applicable excise and gallonage taxes, and submit to commission audits.

• Prohibits direct shipment of beer and distilled spirits without a valid permit, with violations classified as a misdemeanor.
