HB 2316 Summary

• Establishes a temporary Red Hill Bulk Fuel Storage Facility Defueling Commission within the Department of Health to monitor U.S. Department of Defense compliance with court orders, administrative orders, and emergency orders related to the Red Hill fuel storage facility and 2021 water contamination event.

• Commission membership includes the executive director of the Red Hill Compliance Office (chair), director of health, chairperson of the commission on water resource management, manager of the Honolulu board of water supply, two state senators, three state representatives, and one person with fuel storage/transportation expertise.

• Creates a Red Hill Compliance Office within the Department of Health, headed by an executive director appointed by the director of health, to provide technical expertise and support to the commission.

• Commission shall meet quarterly, issue subpoenas to enforce compliance investigations, and submit written updates to the governor and legislature every 30 days after meetings and annually before each legislative session.

• Appropriates state general revenue funds for fiscal year 2022-2023 to establish and operate the compliance office, with costs to be sought back from the Department of Defense; act expires June 30, 2027.
