HB 2336 Summary

• Clarifies that registered owners are strictly liable only for violations of steady red traffic signals when monitored by photo red light imaging detector systems, and excludes liability for other traffic-control signal violations under subsection (a)(1) or (2).

• Expands the definition of "photo red light imaging detector" to include systems using video and other recorded images, and requires devices to work in conjunction with traffic-control signals pursuant to section 291C-32(c).

• Issues warnings instead of citations during the first 30 days of operation for any individual photo red light imaging detector system at a particular traffic signal.

• Eliminates affirmative defenses previously available to registered owners under section 291J-7(b) that allowed them to rebut violations through evidence of theft, emergency vehicle situations, or funeral processions.

• Amends prior appropriations (Act 30, Session Laws of Hawaii 2020) to extend funding timelines through fiscal year 2024-2025 and increases transferred funds to Honolulu prosecuting attorney from $112,602 to $125,779 annually for program personnel costs.
