Establishes the Hawaii Kratom Consumer Protection Act, creating disclosure and labeling requirements for kratom products sold in the state.

Requires vendors to disclose factual basis for kratom product representations on product labels, websites, or QR codes linked to websites.

Prohibits sale of kratom products containing adulterants, dangerous contaminants, synthetic alkaloids, controlled substances, or 7-hydroxymitragynine levels exceeding 2% of alkaloid composition.

Mandates kratom product labels include ingredient lists, alkaloid content amounts, age restriction warnings (under 18 prohibited), vendor contact information, suggested use, and safety precautions.

Establishes penalties of up to $500 for first offense, up to $1,000 for second offense, and three-year sales prohibition for subsequent offenses; violations during prohibition period constitute misdemeanor punishable by up to $2,000 fine and/or one year imprisonment.

Allows aggrieved consumers to bring civil lawsuits for damages and provides vendor immunity if they relied in good faith on manufacturer representations.

Effective January 1, 2023.
