Reduces the required buffer zone around landfills from one-half mile to one-quarter mile in Hawaii Revised Statutes Section 342H-52(b).

Buffer zone applies to new construction, modifications, or expansions of municipal solid waste landfills, construction and demolition landfills, and their components, measured from the edge of waste activity to the nearest residential, school, or hospital property line.

Does not apply to continued operation of existing properly permitted waste or disposal facilities unless expansion requires additional permitting review and permit modification.

Addresses concerns that the stricter one-half mile buffer requirement from Act 73 (2020) limits potential landfill sites and creates risk of siting a new Oahu landfill over a drinking water aquifer.

Takes effect upon approval.
